Welcome to Mawater City (“we”, “us” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website at [www.mawatercity.qa] (the “Site”), and any related mobile application or services we provide (collectively, the “Services”). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, you must not use the Site or Services.

1. Eligibility

1. You must be at least 18 years old and have legal capacity to form binding contracts.

2. You represent and warrant that all information you provide (including as a user or as a dealership/advertiser) is true, accurate, current and complete.

3. If you are a dealership/advertiser, you represent that you are properly licensed/registered to operate in Qatar and you will comply with all applicable laws and regulations.

2. Account Registration

1. To access certain features, you may need to register for an account. You agree to provide accurate, complete and up‑to‑date information.

2. You are responsible for safeguarding your account credentials and for any activity that occurs under your account.

3. You must notify us immediately of any unauthorised use or security breach.

3. Use of the Site & Listings

1. The Services allow dealerships to advertise vehicles to consumers, and consumers to browse, inquire and communicate.

2. When you submit a vehicle listing (as a dealership/advertiser), you represent that the listing is accurate, all required disclosures are made (e.g., condition, mileage, ownership status), and you own or are authorised to advertise the vehicle.

3. We may reject, remove, suspend or modify any listing at our discretion, without notice, especially if it violates these Terms or applicable laws.

4. As a consumer user, you understand that the listing is provided by the dealership/advertiser and we act only as an intermediary/platform. We do not guarantee the completeness, accuracy, condition or legality of any listing or vehicle.

4. Communications & Transactions

1. When you inquire about a vehicle or respond to an advertiser, you understand that any transactions, negotiations, ownership transfers, payment and legal formalities are directly between you and the dealership/advertiser. We are not a party to those transactions.

2. You agree that you will conduct any such transactions in compliance with the laws of Qatar, including vehicle ownership transfer, registration and payment compliance.

3. We are not responsible for any disputes, losses, damages or obligations arising out of these transactions.

5. Fees & Payments

1. Use of the Site for general browsing may be free. If any fee applies (for listing, premium placement, services, etc.), it will be clearly communicated.

2. You agree to pay any applicable fees in the manner specified.

3. All prices/fees are in Qatari Riyal (QAR) unless otherwise stated.

6. Intellectual Property

1. All content on the Site (text, graphics, logos, images, software, etc.) is our property or licensed to us and is protected by intellectual property laws.

2. You may access the Site for your personal, non‑commercial use. You must not reproduce, distribute, modify, create derivative works, publicly display, or otherwise use any content without our prior written consent.

7. Prohibited Conduct

You agree not to:

• Use the Site for unlawful, fraudulent or deceptive purposes.

• Submit listings with false, inaccurate or misleading information.

• Use the Site to infringe the rights of others (privacy, intellectual property, etc.).

• Interfere with or disrupt the Site or any servers or networks connected to it.

• Use any automated system, bots or similar tools to access, scrape or monitor the Site.

• Impersonate any person or entity or falsely state or misrepresent your affiliation.

8. Disclaimers & Limitation of Liability

1. The Site and Services are provided “as‑is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non‑infringement.

2. We do not guarantee the listings, vehicles or advertisers are accurate, complete, legal or trustworthy. You assume all risk in any transaction you choose to undertake.

3. Under no circumstances shall we be liable for any indirect, incidental, consequential, special or exemplary damages arising out of your use of the Site or Services, even if we have been advised of the possibility of such damages.

4. Our total aggregate liability to you in connection with these Terms or your use of the Site shall not exceed the amount you paid (if any) to us in the last twelve (12) months.

9. Indemnity

You agree to indemnify, defend and hold harmless Mawater City, its officers, directors, employees, agents and affiliates, from and against any claims, liabilities, damages, losses or costs (including legal fees) arising from your use of the Site or Services, your violation of these Terms, or your violation of any third‑party rights.

10. Termination and Suspension

1. We may suspend or terminate your access to the Site or Services (or any part thereof) at any time, with or without notice, for any reason, including breach of these Terms.

2. Upon termination, your rights to use the Site will immediately cease. All disclaimers, limitations of liability and indemnities will survive termination.

11. Modifications to Terms

We may revise these Terms at any time. When changes are made, we will update the “Effective Date” at the top of the page. Your continued use of the Site after such changes constitute your acceptance of the new Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Qatar. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Qatar.

13. General Provisions

1. Entire Agreement: These Terms constitute the entire agreement between you and us with respect to your use of the Site, and supersede all prior or contemporaneous agreements.

2. Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, such provision will be struck out and the remaining provisions will continue in full force.

3. Waiver: Our failure to enforce any right or provision under these Terms will not constitute a waiver of that right or provision.

4. Assignment: You may not assign or delegate your rights or obligations under these Terms without our prior written consent. We may assign our rights or obligations at any time without notice.
